Terms and Conditions

  1. Introduction
  2. This page contains the Terms and Conditions henceforth also known as “This Service Agreement” which shall constitute the agreement between yourself, henceforth known as either “You” , “The User” or “Users” and KanStra World Wide Employment. The terms “You”, “The User” and “Users” refer to all individuals and/or entities accessing the KanStra World Wide Employment website for any reason whatsoever. Please read “This Service Agreement” carefully. If you do not accept “This Service Agreement” you may not use the KanStra World Wide Employment website. By “You” using the KanStra World Wide Employment website (other than to read this Agreement for the first time), “You” accept to be bound by, and to comply with “This Service Agreement”. KanStra World Wide Employment may revise and update “This Service Agreement” at any time on this posting and hence you should visit this page periodically to review “This Service Agreement” as it is binding on you. The right to use the KanStra World Wide Employment website is personal to “You” and is not transferable to any other entity or person. KanStra World Wide Employment reserves the right to change or discontinue any part or feature of the KanStra World Wide Employment website at any time, including ( but not limited to ) the adding or changing of fees, prices and tariffs.     You will not:

    1. directly or indirectly, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or underlying ideas or algorithms of the software;
    2. modify, translate, or create derivative works based on the software;
    3. copy (except for archival purposes), rent, lease, distribute, assign, or otherwise transfer rights to the software;
    4. use the software for the benefit of a third party, or remove any proprietary notices or labels on the software.

All rights reserved. “You” may download copyrighted material for your personal use only. “You” acknowledge that “You” do not acquire any ownership rights by downloading copyrighted material. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of KanStra World Wide Employment. “You” acknowledge that KanStra World Wide Employment retains ownership of all software, any portions or copies thereof, and all rights therein. Upon termination of “This Service Agreement” for any reason, “This License” will terminate and you will destroy and cease to use the software. The software is provided “as is” and subject to the warranty, disclaimers and limitations of liability found in “This Service agreement”. You acknowledge that KanStra World Wide Employment retains ownership of all software, any portions or copies thereof, and all rights therein. Upon termination of “This Service Agreement” for any reason, “This License” will terminate and you will destroy and cease to use the software. All other trademarks appearing on the KanStra World Wide Employment website are the property of their respective owners.

  7. User Submissions
  8. As “The User” of the KanStra World Wide Employment website, “You” are responsible for the content of your postings and your own communications and thus for the consequences. “You” must not, and by using this Web Site, you agree not to, do the following things:

    1. Post material that is copyrighted, unless you are the copyright owner or have the permission of the copyright owner to post it;
    2. Post material that reveals trade secrets, unless you own them or have the permission of the owner;
    3. Post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others;
    4. Post material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity;
    5. Post a sexually-explicit image or statement;
    6. Post advertisements or solicitations of business, post chain letters or pyramid schemes;
    7. Impersonate another person;
    8. Post material that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information.

    “You” shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. KanStra World Wide Employment does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by “Users” or endorse any opinions expressed by “Users”. “You” acknowledge that any reliance on material posted by other “Users” will be at your own risk. The KanStra World Wide Employment website acts as a passive conduct for the online distribution and publication of user-submitted information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by “Users”. If notified by a “User” of communications which allegedly do not conform to “This Service Agreement”, KanStra World Wide Employment may investigate the allegation and determine in good faith and its sole discretion whether to remove or request the removal of the communication. KanStra World Wide Employment has no liability or responsibility to “Users” for performance or nonperformance of such activities. KanStra World Wide Employment reserves the right to expel “Users” and prevent their further access to the Web Site for violating “This Service Agreement” or the law and the right to remove communications which are abusive, illegal, or disruptive. KanStra World Wide Employment may take any action with respect to user-submitted information that it deems necessary or appropriate in its sole discretion if it believes it may create liability for KanStra World Wide Employment or may cause KanStra World Wide Employment to lose (in whole or in part) the services of its Internet Service Provider or other suppliers. By submitting content to any public or non-public area of the Web Site, including message boards, forums, contests and chat rooms, you grant KanStra World Wide Employment and its affiliates the loyalty-free, perpetual, irrevocable, sub-licensable (through multiple tiers), non-exclusive right (including any moral rights) and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such content. You also warrant that the holder of any rights, including moral rights in such content, has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the license stated above. You also permit any subscriber to access, display, view, store and reproduce such content for personal use. Subject to the foregoing, the owner of such content placed on the KanStra World Wide Employment website retains any and all rights that may exist in such content.

  9. Prohibited uses of the KanStra World Wide Employment website

    1. The KanStra World Wide Employment website may be used only for lawful purposes by individuals seeking employment and employers seeking employees.
    2. KanStra World Wide Employment specifically prohibits any use of this Site, and requires all users to agree not to use this Site, for any of the following:
      1. “You” may not post to the KanStra World Wide Employment website any incomplete, false or inaccurate Curriculum Vitae henceforth known as a “CV” / Resume information, or information which is not your own accurate "CV"/Resume.
      2. “You” may not post non-resume information such as opinions or notices, commercial or otherwise. Headhunters, employment placement / outplacement agencies, temporary worker agencies, consultants and other third parties, including any third party charging a fee or restricting complete access to all resume information, are prohibited.
      3. Communications soliciting an employer's business by our competitors are prohibited.
      4. “You” may not post to the KanStra World Wide Employment website any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (no significant salary), requires recruitment of other members, sub-distributors or sub-agents.
      5. “You” may not delete or revise any material posted by any other person or entity.
      6. “You” may not print out or otherwise copy or use any personally identifiable information about employees or business information about employers. Unsolicited e-mail, telephone calls, mailings or other contacts to posting individuals and companies are prohibited.

     

  11. Security Rules relating to the KanStra World Wide Employment website
  12. “You” are prohibited from violating or attempting to violate the security of the KanStra World Wide Employment website, including, and without limitation the following:

    1. “You” may not access data not intended for”You” or log into a server or account which “You” are not authorized to access;
    2. “You” may not attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
    3. “You” may not attempt to interfere with the KanStra World Wide Employment website its host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing";
    4. “You” may not send unsolicited e-mail, including promotions and/or advertising of products or services;

Violations of system or network security may result in civil or criminal liability.   15. Registration and Password
  16. You are responsible for maintaining the confidentiality of your information and password. You shall be responsible for all uses of your login email, whether or not authorized by you. You agree to immediately notify KanStra World Wide Employment of any unauthorized use of your login email or password.

  17. Disclaimer of Warranty; Limitation of Liability

The KanStra World Wide Employment website acts as a venue for candidates to post "CV"'s/Resumes and prospective employers to view such "CV"'s/Resumes and does not screen or censor the listings offered. KanStra World Wide Employment is not involved in the actual transaction between employers and candidates. As a result, KanStra World Wide Employment has no control over the quality, safety or legality of the "CV"'s/Resumes posted, or the truth or accuracy of these postings, as well as the ability of candidates to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. “You” assume all risks associated with dealing with other “Users” with whom you come into contact through KanStra World Wide Employment. Because user authentication on the Internet is difficult, KanStra World Wide Employment, cannot and does not confirm that each user is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on the KanStra World Wide Employment website, in the event that you have a dispute with one or more “Users”, you release KanStra World Wide Employment (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of, or in any way connected with such disputes.   19. Liability

KanStra World Wide Employment is not an employment agency or a recruiting firm, and does not guarantee that postings by “Users” will result in employment. Further, KanStra World Wide Employment assumes no liability for claims arising from information entered by “Users”.

  21. “CV”'s/Resumes
  22. The KanStra World Wide Employment website, is a career site and we give you the option of putting your “CV”/Resume in our database. You may store your “CV” / Resume in our database. All prospective employers who access our “CV”/Resume database will have access to your “CV”/Resume. You may remove your “CV”/Resume from our searchable database at any time. However, prospective employers may have retained a copy of your “CV”/Resume in their own files or databases. KanStra World Wide Employment is not responsible for the retention, use, or privacy of “CV”/Resume in these instances.

  23. Children
  24. The KanStra World Wide Employment website does not specifically collect information about children. We believe that children should get their parents' consent before giving out personal information. If you are concerned about your child's use of the KanStra World Wide Employment website, we encourage you to use Web filtering technology to supervise your child's access to the site. We also encourage you to participate in your child's experience with the KanStra World Wide Employment website. With a little guidance, the site can prove very useful in finding a part time or vacation job for your child.   31. No Resale or Unauthorized Commercial Use
  32. “You” agree not to resell or assign your rights or obligations under “This Service Agreement” . “You” also agree not to make any unauthorized commercial use of the KanStra World Wide Employment website.

  33. Termination
  34. KanStra World Wide Employment reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to deletion of your postings from the KanStra World Wide Employment website and immediate termination of your subscription with or ability to access the KanStra World Wide Employment website and / or any other service provided to you by KanStra World Wide Employment, upon any breach by you of “This Service Agreement” or if KanStra World Wide Employment is unable to verify or authenticate any information you submit to the KanStra World Wide Employment website. KanStra World Wide Employment will fully cooperate with law enforcement authorities in investigating suspected lawbreakers, and reserves the right to report to such authorities any suspect activity it becomes aware of.

  35. Monitoring
  36. “This Service” shall have the right, but not the obligation, to monitor the content of the KanStra World Wide Employment website, to determine compliance with “This Service Agreement” of Agreement and any operating rules established by KanStra World Wide Employment and to satisfy any law, regulation or authorized government request. KanStra World Wide Employment shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on the KanStra World Wide Employment website. Without limiting the foregoing, KanStra World Wide Employment shall have the right to remove any material that it my find, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.

  37. Privacy
  38. Your name, email, telephone numbers and fax numbers are not visible to anyone. The information that you supply in the Personal, Education, Experience and Job required sections when submitting your Resume/CV(curriculum vitae) are visible to anyone accessing this site by virtue of the nature of this site. The email that you supply in the Personal section is also not visible to anyone.

    We intend using your name, email, telephone numbers and fax numbers that you submit to us electronically via email or the submission forms on this site only to respond to any specific request for information you have made in this communication, and, with the exception of possible communication and use of this information in terms of the paragraph below, will not use this information in any other way or disclose it to any third party without your express written consent, unless forced to do so by law.

    As a result of your electronic or other communication with us, we may request permission to send electronic messages or other communications of a commercial nature to you, permission that must be explicitly granted by you before we will send such communications. We may also use this information to compile profiles for statistical purposes and use such profiles in the course of our business, but these profiles or statistical data will never be able to be linked to your specific profile and contact details by any third party.

  39. Indemnification
  40. “You” agree to defend, indemnify, and hold harmless KanStra World Wide Employment, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Material or your breach of the terms of these “This Service Agreement”. KanStra World Wide Employment shall provide notice to “You” promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

  41. Zero tolerance Spam Policy
  42. It is strictly forbidden to use the KanStra World Wide Employment website to send spam (unsolicited commercial email). Spamming by the KanStra World Wide Employment website's “Users”, partners or affiliates will not be tolerated. Should we discover that “You” have sent Spam we will immediately cancel any account you may have with us and pursue every available legal remedy and recover any damages caused by sending Spam (unsolicited commercial emails).

  43. Miscellaneous
  44. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of “This Service Agreement” is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that “This Service Agreement” will otherwise remain in full force and effect and enforceable. “This Service Agreement” is not assignable, transferable or sub licensable by “You” except with KanStra World Wide Employment prior written consent. “This Service Agreement” will be governed by and construed in accordance with the laws of the Republic of South Africa without regard to the conflict of laws, provisions thereof. Both parties agree that “This Service Agreement” is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of “This Service Agreement”, and that all modifications must be in a writing signed by both parties, except as otherwise provided herein. No agency, partnership, joint venture, or employment is created as a result of “This Service Agreement” and you do not have any authority of any kind to bind KanStra World Wide Employment in any respect whatsoever. In any action or proceeding to enforce rights under “This Service Agreement”, the prevailing party will be entitled to recover costs and attorneys' fees. All notices under “This Service Agreement” will be in writing and will be deemed to have been duly given when received:

    1. if personally delivered;
    2. when receipt is electronically confirmed,
    3. if transmitted by facsimile or e-mail;
    4. the day after it is sent, if sent for next day delivery by recognized overnight delivery service;
    5. and upon receipt, if sent by certified or registered mail, return receipt requested.

     

  45. General
  46. KanStra World Wide Employment makes no claims that the Materials may be lawfully viewed or downloaded outside of the Republic of South Africa. Access to the Materials may not be legal by certain persons or in certain countries. If you access the KanStra World Wide Employment website from outside of the Republic of South Africa, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. “This Service Agreement” is governed by the laws of the Republic of South Africa, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the courts of the Republic of South Africa. If any provision of “This Service Agreement” is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of “This Service Agreement”, which shall remain in full force and effect. No waiver of any term of “This Service Agreement” shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in the other areas of this “Legal Page”, “This Service Agreement” constitute the entire agreement between “You” and KanStra World Wide Employment with respect to the use of the KanStra World Wide Employment website. No changes to “This Service Agreement” shall be made except by a revised posting on this page.
